بے انصافی کی مٹی

پرنس ہیری برطانیہ کے ولی عہد شہزادہ چارلس اور آنجہانی لیڈی ڈیانا کے دوسرے صاحبزادے ہیں، برطانیہ کی متوقع بادشاہت میںہیری تیسرے نمبر پرآتے ہیں،پرنس ہیری۵۱ستمبر۴۸۹۱ءمیں پیدا ہوئے اور ان کی والدہ انہیں عام انسان دیکھنا چاہتی تھی چنانچہ لیڈی ڈیانا نے شاہی روایات توڑتے ہوئے ہیری کو عوامی پارکوں، کھیل کود کے میدانوں، میکڈونلڈ اور سینما گھروںمیں لے جانا شروع کیا، پرنس ہیری بارہ برس تک اپنی ماں کے ساتھ لندن کی عام زندگی دیکھتے رہے لیکن پھر۷۹۹۱ءمیں لیڈی ڈیانا کا انتقال ہوگیا اور ہیری دوبارہ شاہی خاندان کی روایات میں دفن ہوگئے،وہ ۸۹۹۱ءمیں سکول کی تعلیم کے لئے ایٹن (ETON)آئے تو انہوں نے آزادی کا ذائقہ چکھنے کے لئے سپورٹس کا سہارا لیا، وہ فٹ بال، سکینگ اور گھڑ سواری میں دلچسپی لینے لگے، پرنس ۵۰۰۲ءمیں ملٹری اکیڈمی سینڈ ہرسٹ میں داخل ہوئے، انہوں نے ۴۴ہفتے کی عسکری ٹریننگ لی اور برطانوی فو ج میں شامل ہوگئے،انہوں نے ونڈ سر میں بلیوز اور رائل رجمنٹ جوائن کرلی، وہ اب برطانوی فوج میں سیکنڈ لیفٹیننٹ ہیں اور اپنی رجمنٹ کے ساتھ تمام خطرناک اور مشکل آپریشنز پر جاتے ہیں۔

پرنس ہیری اکتوبر۷۰۰۲ءکے آخر میں شدید قانونی مشکلات کے شکار ہوگئے ،وہ برطانوی اخبارات کی ”کورسٹوریز“اور ٹیلی ویژن کی خبروں میں بھی بری طرح ”ان “ہوگئے پرنس ہیری کی مشکلات کا پس منظر بہت دلچسپ تھا،مشرقی برطانیہ کے علاقے نور فوک(Norfolk)میں ملکہ برطانیہ کی بہت بڑی جاگیر ہے،اُس کا نام سینڈرنگ ہیم ہے اور اس میں ایک شاہی محل اور ایک طویل جنگل ہے،اکتوبر کے آخری ہفتے پرنس ہیری نے اپنے ایک دوست کے ساتھ اس جاگیر پر قیام کیا،اس جاگیر میں بعض نایاب پرندے بھی موجود ہیں،برطانیہ نے ان پرندوں کے شکار پر پابندی لگا رکھی ہے،ان پرندوں میں ایک خاص قسم کی مرغی) Herrier (بھی شامل ہے،اُس پرندے کا نر گرے جبکہ مادہ براﺅن رنگت کی ہوتی ہے اور یہ خوراک کی تلاش میں پرواز بھی کرسکتی ہے۔

اکتوبر کے آخرمیں پرنس ہیری اور اس کا دوست شکار کے لئے جنگل میں نکلے،اس وقت ہوا میں دو ہئیریر اڑ رہی تھیں،جنگل میں اچانک دو فائر ہوئے اور یہ دونوں پرندے زخمی ہو کر گر گئے،سینڈرنگ ہیم کے قرب و جوار میں اس وقت دو عام شہری اور جنگلی حیات کا ایک وارڈن موجود تھے،ان لوگوں نے فوراً پولیس کو اطلاع کردی،پولیس فوری طور پر سینڈرنگ ہیم پہنچی اور اس نے پرندوں کی لاشیں قبضے میں لے لیں،جس کے بعد شہزادے سے ابتدائی تفتیش شروع ہوگئی،شہزادے نے اس واقعے سے لاتعلقی ظاہر کی لیکن پولیس نے اسے تفتیش کا حصہ بنا لیا،یہ واقعہ دوسرے دن اخبارات کی شہ سرخی بن گیا،شاہی خاندان کا ترجمان یہ اعلان کر نے پر مجبور ہوگیا،اگر شہزادہ قصور وار ثابت ہوا تو اس کے خلاف قانونی کارروائی کی جائے گی ”برطانوی قانون میں اس پرندے کو نقصان پہنچانے کی سزا چھ ماہ قید اور پانچ ہزار پاﺅنڈ جرمانہ ہے،برطانوی قانونی ماہرین نے قومی پریس کو بتایا کہ اگر شہزادے کے خلاف جرم ثابت ہوگیا تو اسے نہ صرف یہ سزا بھگتنا پڑے گی بلکہ اسے فوج سے بھی فارغ کردیا جائے گا۔پھر دنیا کے تمام باخبر میڈیا نے اس کاروائی کو مانیٹر بھی کیااوربرطانیہ کی عدالتی کاروائی کو تحسین کے کلمات سے بھی نوازا۔

آپ پرنس ہیری کے خلاف چھپنے والی تمام رپورٹس کو آج بھی پڑھ لیں،ان رپورٹ میں چارچیزیں نمایاں ہیں، اول برطانیہ میں کوئی رکن اسمبلی، کوئی لارڈ، کوئی جرنیل اور شاہی خاندان کا کوئی فرد قانون سے بالاتر نہیں،دوم برطانیہ میں عام شہری سے لے کر جنگلی حیات کا وارڈن تک برطانوی خاندان کے خلاف شکایت کرسکتا ہے اور پولیس تفتیش کے لئے شاہی محل میں بھی داخل ہوسکتی ہے،سوم برطانیہ کے شاہی خاندان کے چھوٹے سے چھوٹے جرائم بھی میڈیا میں آجاتے ہیں اور خاندان کا کوئی فرد میڈیا پر اثر انداز ہونے کی کوشش نہیںکرتا اور چہارم اگر شاہی خاندان کے کسی فرد کے خلاف جرم ثابت ہو جائے تو برطانوی عدالتیں فیصلہ سناتے دیر نہیں لگاتیں اور اس فیصلے پر فوراً عمل درآمد ہوتا ہے،میں جب برطانوی معاشرے کی ان خوبیوں کا مطالعہ کر رہا تھا تو میں ساتھ ساتھ اپنے پاکستانی معاشرے کا جائزہ بھی لے رہا تھا۔

برطانیہ ہمارا آقا تھا،وہ ہم پر ڈیڑھ سو سال حکومت کرتا رہا تھا۔لیکن بعد ازاں ہمیں محسوس ہوا ہم مسلمان ہیں اور مسلمان نظریات، خیالات اور روایات میں برطانیہ کے کافروں سے بہت آگے ہیں چنانچہ ہمیں کافروں سے آزادی حاصل کرنی ہے، ہم نے ۷۴۹۱ءمیں کافروں سے آزادی حاصل کرلی لیکن ۷۰۰۲ءمیں ہمارے کافر آقاﺅں کی اخلاقیات اور قانون پروری کا یہ عالم دنیا نے ملاحظہ کیا کہ وہاں دو پرندوں کے قتل پر نہ صرف پولیس شاہی شکار گاہ میں داخل ہوجاتی ہے بلکہ شہزادے کی دو دو بار تفتیش ہوتی ہے اورشہزادہ میڈیا سے منہ چھپاتا پھرتا ہے جبکہ ہم جیسے اہل ایمان کے ملک میں سپریم کورٹ صدرزرداری کے دوعہدوں کی قانونی حیثیت پر سماعت شروع کرتی ہے تو بابر اعوان جو پی ایچ ڈی کی مشکوک ڈگری کے ساتھ وزارتِ قانون کا قلمدان سنبھالے ایک مخصوص چارٹر طیارے کے ذریعے ملک بھر کی بارکونسلز میں کروڑوں روپے بانٹ رہے ہیں‘کے حکم پر نیب کا سربراہ سپریم کورٹ کو اپنے خط میں ملک کی اعلیٰ عدلیہ کے چیف جسٹس چوہدری افتخار کی تقرری کو غیرقانونی قراردیکر ملک کو ایک نئے بحران میں مبتلا کرنے کی کوشش شروع کردیتا ہے۔

 میں سوچ رہا تھا، ایک طرف ”کافروں “کے شہزادے دو پرندے مارنے کے جرم میں قانون کے شکنجے میں آجاتے ہیں جبکہ دوسری طرف اللہ تعالیٰ کی محبوب ترین قوم کے حکمران خود کو قانون اور آئین سے بالاتر ثابت کردیتے ہیں، مجھے کل ایک دوست بتا رہے تھے پاکستان کی تاریخ میں پہلی بار عدلیہ آزاد ہوئی ہے، اب جج پیچھے نہیں ہٹیں گے ، میں نے پوچھا ”اگرملک میں مائنس تھری کا فارمولہ آگیا تو؟“ !“انہوں نے فرمایا”اگر کوئی ایسا فارمولہ آیا تو جج اس فارمولے کی سخت مزاحمت کریں گے اور وہ معمول کے مطابق کام کرتے رہیں گے“میں نے پوچھا ”اگر حکومت نے ان کے دروازوں پر پولیس یا فوج بٹھا دی تو !“انہوں نے فوراً جواب دیا ”اگر حکومت نے ایسا کیا تو ملک میں خانہ جنگی شروع ہو جائے گی،عوام ظالموں کو سڑکوں پر گھسیٹیں گے“وہ رکے اور دوبارہ بولے ”آپ ہماری بدقسمتی دیکھئے، ہم صرف ایک شخص کو بچانے کےلئے پاکستان کے تمام ادارے تباہ کر رہے ہیں،ہم قانون اور آئین کی دھجیاں بکھیر رہے ہیں، ہم اللہ کے سامنے کیامنہ لے کر جائیں گے !“میں نے انہیں پرنس ہیری کا واقعہ سنایا اور عرض کیا ”قیامت کے دن یہ لوگ ہمارا منہ چڑائیں گے “۔

ہمارے حکمرانوں کو کون بتائے دنیا کے تمام مذاہب کی کوئی نہ کوئی ایک بڑی خصوصیت ہے مثلاً ہندومت عاجزی کا مذہب ہے(بلاشبہ موجودہ ہندو قیادت بھی اس پر عمل نہیں کررہی)،بودھ بے لوث ہوتے ہیں اور عیسائیت قربانی اور یہودیت بالا دستی کا درس دیتی ہے جبکہ اسلام عدل کا نام ہے،اگر ہم اسلام سے عدل اور مسلمانوں سے انصاف نکال دیں تو پیچھے سو کلو گرام گوشت کا ڈھیر رہ جاتا ہے لیکن آپ ہماری بد قسمتی دیکھئے آج یہودی، عیسائی، بودھ کے پیروکار جانوروںتک سے انصاف کر رہے ہیں،ان کے معاشروں میں ملکہ سے لے کرفریادی تک کو یکساں حقوق حاصل ہیں،وہا ں دو پرندوں کی لاشیں بھی زنجیر عدل ہلا دیتی ہیں لیکن اللہ تعالیٰ کی محبوب قوم کے حکمران ہرروز انصاف، قانون اور عدل سے جوتے صاف کرتے ہیں، وہ پوری دنیا کو مخاطب کر کے اعلان کرتے ہیں، ہمارے خلاف فیصلہ آنے کا امکان ہوا تو ہم ملک میںہرقدم پر اس کی مزاحمت کریں گے۔

ذرا دل پر ہاتھ رکھ کر بتائیے آج اگر برطانیہ کی عدالتیں شاہی خاندان کو محلات خالی کرنے کا حکم دیتی ہیں تو کیا ملکہ کے پاس کوئی دوسرا راستہ ہوگا؟اب آپ اللہ کے نام پر بننے والے پاکستان کو دیکھئے ہماری سپریم کورٹ کے احکامات کی کس قدر تحقیر ہورہی ہے۔اس کے فیصلوں پر عمل درآمد کی بجائے دوسرے تاخیری حربوں سے کام لیکر کبھی وزارتِ قانون کا سیکرٹری استعفیٰ دیکر گھر چلا جاتا ہے یا پھر عین مقدمے کے دوران حکومتی وکلاءکو تبدیل کرکے مزید وقت حاصل کرنے مظالبہ کرلیا جاتا ہے۔ایک لمبے عرصے تک نیب کو کسی سربراہ کے بغیر محض اس لئے چلایا جاتا ہے کہ عدالتی کاروائی کا مذاق اڑایا جائے اوراب نیب کی طرف سے چیف جسٹس اوران کے تمام ساتھیوں کی تعیناتی کو مشکوک اورغلط قرار دیکر ایک نئی لاحاصل اورغیرقانونی جنگ کے آغاز کا اعلان کردیا گیا ہے۔

فاسق کمانڈو جنرل مشرف کے دورِ حکومت میں بھی ایسے ہی اوچھے ہتھکنڈے استعمال کئے گئے تھے جب نواز شریف کی واپسی کا حکم دیا تھا لیکن مشرف کی حکومت نے انہیں جہاز میں بٹھا کر سعودی عرب بھجوادیا تھا لیکن شاہ عبداللہ نے اس بے انصافی کو قبول نہ کرتے ہوئے ان کو دوبارہ پاکستان اپنی ضمانت پر بھجوادیا تھا۔اس وقت بھی ملک کا وزیرِ اعظم شوکت عزیز اوروزیرِقانون انصاف اور قانون کے ساتھ یہ کھلواڑ کررہے تھے حالانکہ اس سے ایک رات قبل پرائم منسٹر ہاﺅ س میں مولانا طارق جمیل سے عدل و انصاف کے موضوع پرایک لیکچر سن رہے تھے اوریقینا مولانا جمیل گفتگو اللہ کے نام سے شروع کرکے اللہ ہی کے نام پرختم کی ہوگی،مجھے بتائیے جس ملک کا ایک سنئیر ترین جج جسٹس خلیل رمدے سرکاری وکیل کو بھری عدالت میں یہ کہنے پر مجبور ہو جائے ”زبان کو لگام دو“وہاں عدالتی کاروبار کس طرح چلتا ہوگا۔

حضرت علیؓ نے چودہ سو سال پہلے فرمایا تھا دنیا میںکفر کی حکومت قائم رہ سکتی ہے لیکن بے انصافی کی نہیں اور ہم وہ بدنصیب لوگ ہیں جن کی حکومتوں کے سارے پائے بے انصافی کی مٹی سے بنتے ہیں اور صرف وہ لوگ حکومت کرسکتے ہیں جن کے ڈنڈے لمبے ہوتے ہیں یا جو اپنے اپنے ضمیر کے گورکن ہوتے ہیں۔لےکن کب تک؟؟؟؟

Gujarat: Making of a Fascist State

 Abdul Shakeel Basha, known popularly as Shakeel to his friends, has been arrested on 17^th June 2010, on various charges. The major charge is that he along with his other friends was planning to start a Maoist revolution in Gujarat. Shakeel is 13^th amongst the activists who have been arrested on similar charges. Activists who have been arrested on the charge of being Naxalites are Avinash Kulkarni, Bharat Pawar, Makabhai Chowdhary, Jayaram Goswami and others who have been working in different parts of Gujarat, particularly amongst the tribal and workers for their economic rights. There has been no news of any violence in the areas where they have been working. One knows Shakeel has a long record of working for communal harmony, justice for Gujarat violence victims, and housing for street children amongst other issues. ‘Peace issues’ has been his concern during last few years.

 Apart from Shakeel the work of most of these activist’s, arrested by Gujarat police, has been within the confines of Indian Constitution, struggles based on the ‘rights as citizens’, as weaker sections of society. The major violence witnessed by Gujarat has been the one of sectarian type, the one directed first against Muslim minorities and then Christian minorities. On the contrary the work of some of these activists has been to promote communal harmony, which has been a hindrance to spread of divisiveness being promoted by the likes of Swami Aseemanand of VHP, an RSS affiliate, who is currently absconding for his linkages with the perpetrators of Ajmer terror attack.

 With the nation wide beginning of operation ‘green hunt’, the targeting of Naxalites/Maoists, the Gujarat police, not to be left behind, has targeted the activists working within the confines of constitutional limits. Gujarat has never been known to be the work area of Naxalites/Maoists anyway. This has been an area where the followers of RSS have been calling shots from last two decades in particular and trying to convert it into ‘ideal Hindu state’. Gujarat has also been boasted as the ideal Hindu state, particularly since the violence against minorities became intense. The anti Muslim offensive culminated in Gujarat carnage of 2002. After 2002 there was a sustained attack on Christians. This is the violence which is the marker of Gujarat.

 One never heard of any Naxalite violence and there are no criminal cases against most of the activists who have been arrested. As such through the intense media propaganda, social activists have been defamed to the extent that Medha Patkar was attacked physically for her campaigns to protect the rights of tribal. Strong propaganda against ‘activists’ in general is part of the norms prevalent in Gujarat.

 The sequence of the political events in Gujarat is very revealing. First the sectarianism comes up; various factors promote this communal divide. This leads to the massive anti Muslim pogrom on the pretext of Godhra train burning. Then on the plea that Christian missionaries are converting the gullible Adivasis, anti Christian violence is unleashed. This runs parallel with the aggressive conversion of Adivasis into Hinduism under the garb of ‘Ghar vapasi’. Through Vanvasi Kalyan Ashram, through swamis and associates identity issues are projected in the Adivasi areas. The result of all this is the overall suspension of the concept of Human rights and demonization of social activists. As such whatever little is there in the name of social activism has been dwarfed under the shadow of communalization of social space and communal violence.

 Due to these anti minority attacks, minorities have been relegated to second class citizens. The culmination of this is the formation of Muslim ghettoes in urban areas and intimidation of Christians in Adivasi areas. Along with this the concept of ‘Swarnim Gujarat’ (Golden Gujarat), a heaven for investors is advertised through media. In tandem with this the rights of workers and tribal are being suppressed to ensure that the industrialists can have their sway to make big money. As Ratan Tata put it, industrialists have to be in Gujarat. And so Anil Ambani and others of their ilk project Narendra Modi as the ideal Chief Minister, the future Prime Minister of India. The inference is emerging that anti minority pogrom has effectively been undertaken to create a ‘smooth’ atmosphere for the industrialists. After subjugating minorities and the democratic values the illusion of ‘development’ has been manufactured.

 Narnedra Modi has been compared to Hitler times and over again. Through his anti Jew, anti Communist tirades Hitler created the ‘ideal’ atmosphere for the big industrialists. It seems Modi has taken Gujarat on the same path. First he has ensured the suspension of human rights through anti-minority pogroms, then demonized the social activists and now whatever little activity prevailed for democratic rights of the marginalized, is being done away with. The human rights workers, working in the Constitutional framework are being dubbed as Naxalites and are being put behind the bars. The idea is to smoothen the path for big industrialists. The arrest of workers for human rights issues is like laying the red carpet for the reckless growth of industries, trampling on the interests of the deprived sections of society. What is hidden below the red carpet is the very concept of a welfare state, a secular state, a state with the concept of human rights of all. One is also reminded of the RSS ideologue M.S. Golwalkar writing in his book ‘Bunch of Thoughts’ that Muslims, Christians and Communists are the internal threat to Hindu nation. It seems following his advice first the Muslims, then the Christians and now the social activists (communist substitutes) are being targeted as Naxalites. 

 The happenings in Gujarat show us the deeper designs of the political class of the country, who are executing industrialization without a human face, industrialization on the bodies of the marginalized sections. Hitler did precisely the same. In the short term it seems very rewarding but surely one knows from History that once the violation of the concepts of democracy goes too far, the results are not very pleasing. Hitler refused to learn it in his life, that’s why he had to put a bullet in his head. Germany kept toeing his line, that’s why it faced the ruin after the temporary graphs showing economic prosperity!

 One reaffirms that those believing in the ‘violence as a means for social change’ have no place in the democratic system. In turn, one must learn that democracy is doomed in a state which does not let the peaceful social movements to exist!

ٹیکسوں کی ادائیگی

کسی بھی ملک کی معاشی ترقی کے لئے ٹیکسوں کی وصولی بنیادی حیثیت رکھتی ہے۔ملکی حالات کو مد نظر رکھتے ہوئے ملک میں ٹیکس کی وصولی کے نظام کو بہترین بنانے کی ضرورت ہے،مگر اس طرف بالکل توجہ نہیں دی جا رہی۔بدقسمتی سے پاکستان میں ٹیکس کلچرفروغ ہی نہیں پاسکا۔پاکستان وہ ملک جہاں کے باسی سالانہ اربوں روپے خیرات میں دیتے ہیں مگر اکثر امیرزادے ٹیکس دینا پسند نہیں کرتے اور پاکستان کو باپ کی جاگیر سمجھتے ہیں۔پاکستان کا شمار ان ملکوں میں ہوتا ہے جہاں کے لوگ فی کس آمدنی کے لحاظ سے سب سے زیادہ رقم فلاحی اداروں کودیتے ہیں۔ایدھی ٹرسٹ کو ایشیاءیاشایددنیا کا سب سے بڑا فلاحی ادارہ کہا جاتا ہے۔جومکمل طور پر لوگوں کی امداد پر چل رہا ہے۔اس کے علاوہ شوکت خانم ہسپتال اور دوسرے بڑے ادارے بھی موجود ہیں۔اس کی بڑی وجہ اس بات پر یقین ہے کہ جو رقم ان اداروں کو دی جارہی ہے وہی صحیح طریقے سے خرچ ہورہی ہے۔پھر پاکستان وہ ملک ہے جہاں کے لوگ سب سے کم ٹیکس دیتے ہیں۔پاکستان کی 180ملین کی آبادی میں سے صرف 17ملین لوگ ٹیکس گذار ہیں۔پاکستانی جی ڈی پی کا صرف 10%ٹیکسوں کی شکل میں آتا ہے۔ایک رپورٹ میں ہیمبرگ یونیورسٹی کے ایک ماہرمعاشیات کی تحقیق کے مطابق کسی قوم کی معیشت،معاشرت اور تاریخ کا گہراتعلق ٹیکس کلچر سے ہوتا ہے،پاکستان بھی اس الگ نہیں۔ہمارے ملک میں ٹیکس وصولی کا نظام نہایت فرسودہ اور ایک لحاظ سے ناانصافی پرمبنی ہے۔پاکستان وہ ملک ہے جہاں پر لوگوں کی دولت پر ٹیکس بہت کم لیا جارہا ہے۔جو کروڑوں اربوں روپے کی جائیدادیں رکھتے ہیں وہ کسی نہ کسی طرح سے ٹیکس بچا رہے ہیں۔ ان ڈائریکٹ ٹیکس کی بات کریں تو یہ ٹیکس عام عوام سے ایک طرح زبردستی یااُنہیں بتائے بنا وصول کیا جا رہا ہے۔اسی ان ڈائریکٹ ٹیکس کی وجہ سے مہنگائی میں اضافہ ہوتا ہے اور لوگوں کی قوت خرید متاثر ہوتی ہے۔عام صارفین پر لگائے گئے ٹیکس کاانحصار اس بات پر ہوتا کہ جانا جاسکے کہ عوام کی قوت خریدکتنی ہے۔اس صورت میں سپلائی چین خودبخودریونیواکٹھا کرنے کا باعث بنتی ہے۔ملکی پیدا واراور صارفین کو بڑھانے کا ایک اور اہم طریقہ تو یہ ہے کہ برآمدات میں اضافہ کیا جائے۔سیلزٹیکس کو انسانی تاریخ کا سب سے پرانا ٹیکس کہا جاتا ہے۔ اس کی بنیاد یہ ہے کہ ہر بڑی ٹرانسزکشن پر ٹیکس وصول کیا جائے اور اس کا بوجھ آخری صارف تک منتقل کیا جائے۔پاکستان میں سیلزٹیکس اور جنرل ٹیکس ہی ریونیوکے بڑے ذرائع بنے ہوئے ہیں۔پاکستان میں لوگ خوشی سے ٹیکس کیوں نہیں ادا کرتے اور یہاں ٹیکس کلچر کیوں نہیں پنپ سکا؟ویسے تو اس کی بہت سے وجوہات ہیں۔ لیکن سب اہم وجہ کرپشن ہے،ٹیکس گذار اور حکومت کے درمیان اعتمادکا فقدان ہے۔اصل مےں کرپشن کی وجہ سے لوگوں کو اس بات کا ہرگزیقین نہیں کہ ان کا ادا کردہ ٹیکس صحیح ہاتھوں میں جارہا ہے۔جب وہ دیکھتے ہیں کہ ان کے ٹیکس ادا کرنے کے باوجود بھی ملک کی حالت ویسی ہی ہے تو ہر کوئی ٹےکس سے بچنے کی خاطر نت نئے طرےقے سوچتا ہے اور پاکستان میں کوئی ایسا کام نہیں جو ناممکن ہو،البتہ پےسہ ہونا ضروری ہے۔حکومت لوگوں کے بنیادی حقوق بھی ادا نہیں کررہی،ٹوٹی ہوئی سڑکیں،صاف پانی کی نایابی،ہسپتال ، صحت کی سہولیات کا کم ہونا اور دوسری بے شمار ضروریات جولوگوں کا حق ہیں،وہ مہیا نہیں کی جا رہےں۔توپھر یہ قدرتی امرہوگا کہ عام لوگ سمجھیں گے کہ ان کا ٹیکس دینا پیسے کا زیاع ہے۔پھر یہ ناانصافی بھی نظر آتی ہے کہ ملک کی دولت مند اشرافیہ ،جاگیردار،سیاستدان،سرمایہ کار سالانہ اربوں کھربوں روپے کا ٹیکس ادا نہےں کر رہے ےعنی چوری کررہے ہیں،ملک سے بےوفائی کر رہے ہےں،ملک سے غداری کر رہے ہےں۔ترقی یافتہ ملکوں میں صورتحال اس کے برعکس ہے۔ حالیہ عالمی مالیاتی بحران کی وجہ سے جرمنی کی معیشت کو بھی نقصان پہنچا۔جرمنی ایک ویلفئیراسٹیٹ ہے۔حکومت پناہ گزینوں،بیروزگاروں،بزرگ افراد اور طالب علموں کی مدد کرتی ہے۔کچھ عرصہ قبل معاشی بحران کی وجہ سے حکومت اس معاملے میں دباؤکاشکار ہوگئی تھی۔اس صورتحال میں جرمنی کے محب وطن لوگوں نے حکومت کی مدد کرنے کی ٹھانی جو کہ دنےا بھر مےں محب الوطنی کا جذبہ رکھنے والوں کے لئے مثال تھی۔اُس وقت جرمن حکومت کو مالیاتی خسارے کا سامنا تھااور لوگوںکا کوالٹی آف لائف برقراررکھنا مشکل ہوگیا تھا۔ان حالات میں ”سرمایہ داروں پر ٹیکس بڑھاؤگروپ“سامنے آیا۔یہ جرمنی کے تاجروں ،سرمایہ داروں،صنعت کاروں کا ایک دلچسپ گروپ ہے۔اس میں جرمنی کے چوٹی کے بزنس مین شامل ہیں۔ان لوگوں کا مطالبہ ہے کہ ”ہم دنیا کے خوشحال ترین لوگ ہیں،ہمارے پاس ہماری ضرورت سے بہت زیادہ سرمایہ ہے۔اس لئے حکومت ہم پر 5فیصد مزیدٹیکس بڑھا دے۔ “اس سے حکومت کو مزیدسواارب یورو کی آمدن ہوئی اور حکومت اس کی مدد سے عام شہریوں،بے روزگاروں،بے گھرلوگوں، طالبعلموں اور غربت کے شکار خاندانوں کی مدد کرسکے گی۔اس گروپ کا کہنا ہے کہ حکومت ہراُس جرمن شہری پر 5فیصدڈائریکٹ ٹیکس لگا دے جس کے اثاثے 5لاکھ یورو سے زائد ہیں۔اس سے جرمنی کے لوگوں کا معیارزندگی خراب نہیں ہوگا۔دولت مندوں کے اس گروپ نے برلن میں ایک مظاہرہ بھی کیا۔مظاہرے کے دوران گروپ کے اراکین نے اپنے ہاتھوں سے یوروکے نوٹ ہوا میں لہرائے اورنعرہ لگایا کہ ”ہمارے پاس دولت ہے۔ہم سے ہماری دولت لے لوتاکہ جرمنی ترقی کرسکے“۔کاش اےسے محب وطن پاکستان مےں بھی ہوتے۔مگر پاکستان مےں ٹےکس وصول کرنے والوں کی جےبوں مےںجہنم ےعنی رشوت ڈال کر ملک سے غداری کا ثبوت دےا جاتا ہے۔پاکستان کے بڑے بڑے بزنس مینوں اور سرمایہ داروں کے اثاثوں اور ان پر ادا کئے گئے ٹیکسوں کی تفصیلات زیربحث رہی ہیں۔ایک تحقیق کے مطابق صدرآصف علی زرداری کا شمارملک کی امیرترین شخصیات میں ہوتا ہے۔انہوں نے 1992-93میںصرف 2621روپے۔1993-94میں صرف 3152روپے۔1994-95 میں صرف 8492روپے۔1995-96میں صرف 8492روپے اور1996-97میں صرف 8152روپے ٹیکس ادا کیا تھا۔یہ ہی صورتحال پاکستان کے دوسرے بڑے سیاستدانوں کی ہے۔جن مےں مےاں برادران کا چہرہ بھی عوام کے سامنے آگےا کےونکہ وہ اپنی کُل جائےداد پر صرف پانچ ہزار روپے ٹےکس ادا کرتے ہےں۔پچھلے الیکشن میں اراکین پارلیمنٹ نے اپنے اثاثے ڈکلیرکئے تھے۔ ان اثاثوں کے مطابق اراکین پارلیمنٹ کی اکثریت غریب،مسکین اور بے گھر نکلی78ارکان کے پاس ذاتی مکان ،ذاتی گاڑی اور ذاتی زمین نہیںتھی ظاہر ہے یہ لوگ ڈائریکٹ ٹیکس مستثنٰی قرار پاتے ہیں۔ان لوگوں کا لائف سٹائل دیکھ کر دل نہیں مانتا کہ جو اثاثے انہوں نے ظاہر کئے ہیں وہ ٹھیک ہیں۔جس ملک میں غربت کی لیکر سے نیچے زندگی بسرکرنے والے42فیصد لوگ بھی 76فیصداِن ڈائریکٹ ٹیکس ادا کرتے ہیںاس میں آصف علی زرداری سمیت ملک کے تمام بڑے بڑے سیاستدان ٹیکس سے مستثنیٰ ہیں۔پاکستان میں اندازاً اس وقت50لاکھ افرادکروڑپتی اور10ہزارارب پتی ہیں۔ملک کے ٹاپ ٹوینٹی کے پاس اتنی دولت ہے کہ پاکستان کے تمام بچوں کو مفت تعلیم دی جاسکتی ہے۔یہ بات من اظہرالشمس ہے کہ اگر پاکستان کے دولت مندلوگ ایمانداری سے ٹیکس اداکریں تو پاکستان کو کہیں سے امدادلینے کی ضرورت نہ پڑے۔جس کی وجہ سے اس ملک کو عزت نفس اور قومی مفادات کی قربانی دینی پڑتی ہے۔

Misleading the Kashmiri youth is Lucrative Business

             Hats off to the Pakistani propaganda machinery which has convinced a section of Indians, including Kashmiris, that the Kashmir “problem” relates only to that part of the state which is with India and that the problem has persisted for the past 63 years because of India’s refusal to hold a plebiscite there – a historical fallacy.

             But what is the actual problem in Kashmir? Last week, at the height of the agitation in Kashmir, leader of a faction of the Hurriyat Conference, Mirwaiz Umar Farooq told a private TV channel very emotionally that he didn’t want peace but “solution”. But solution of what? Leaders, who live by agitational politics, daily hartals and use of young people as fodder in Kashmir, fight shy of giving one definition of this “problem”. But they all want a “solution”. Syed Ali Shah Gilani, who has named his faction of the Hurriyat Conference as Tehrik-i-Hurriyat wants Kashmir to join Pakistan. He makes no bones about his allegiance to Pakistan. The Mirwaiz does not agree with that and would rather like to be called “a moderate”- a better bargaining strategy vis-a-vis New Delhi and Islamabad. Kashmiri leaders outside the Hurriyat too are diffident about one definition of the “problem”. In fact, no two Kashmiri leaders agree on one definition of the “problem”.

             Pakistan’s changing stance on Kashmir also reflects diffidence about the identity of the problem. For example, before the creation of Pakistan, Mr. Mohammad Ali Jinnah encouraged Maharaja of Kashmir Hari Singh to declare independence. But once Pakistan was created he lost no time in allowing invasion and plunder of Kashmir by Pakistani Army backed Mehsud tribesmen. These tribesmen have now turned against Pakistan. Mr. Jinnah committed his blunder because he had not studied history although he was a good lawyer. That was the first change in the stance on Kashmir.

             Then, followed many other changes. Along with India, Pakistan was a party to the Security Council’s resolution calling for a plebiscite in the entire state of Kashmir as it existed in August 1947. The very first step for holding this plebiscite was that Pakistan’s Army and its nationals must vacate the Kashmiri territory occupied by them through invasion to facilitate the plebiscite. Pakistan flouted this precondition by not pulling out its Army and the nationals from the invaded territory. It also gave away a large chunk of territory of occupied Kashmir in Hunza to China thereby trivializing the UN resolutions. These two actions of Pakistan were meant to thwart a plebiscite and the Kashmir’s right of self determination. But Pakistan very effectively propagated throughout the world that India was refusing to hold the plebiscite and that it said, was the problem in Kashmir. India, complacent with truth on its side, did little to effectively counter this propaganda.

             Pakistan, because of the history of invasion and plunder of Kashmir in 1947 and also because of political instability and chaos, really did not want a plebiscite in Kashmir In the early 1990’s, it gave a new twist to the Security Council’s resolutions. It said the problem only concerned that part of Kashmir that was with India. It did not say what was the basis of the claim. Accordingly to it, the security council resolutions applied only to the Indian part of Kashmir and therefore, it is there the plebiscite should be held, not in Azad Kahsmir and Gilgit Baltistan where there are suppressed movements against the Pakistan’s occupation. In 1994, Pakistan changed its emphasis from plebiscite to human rights in Kashmir just when terrorists backed by it were massacring people in Kashmir.

             Beginning from 1989 the Pro-Pakistan Islamic militants and terrorists were trying to Islamise Kashmir, among other things, by driving out non-Muslims from the valley and also by destroying shrines that Muslims and Hindus venerated for centuries. Thus, terrorists used Islam as an instrument of terror to make people shout anti-India slogans and Kahsmiri leaders made statements pleasing to separatists and terrorists. The Kashmir leaders, especially those belonging to the Hurriyat Conference, want young Kashmiri to get their inspiration from Pakistan, but they will never tell them about the plight of Kashmiris in the part of Kashmir which is under Pakistan’s occupation. The big question is : do the Kashmir leaders accept or reject the Pakistan’s claim that its occupation of a part of Kashmir has solved the Kashmir problem in respect of that area? If yes, they should be bold enough to tell the Kashmiri youth that that is the ideal solution of the Kashmir problem. But if they reject this claim of Pakistan, they should be bold enough to say so instead of misleading the Kashmiri young people and causing starvation to poor Kashmiris by daily hartals in the valley. The Hurriyat and the Kashmiri leaders can join together and put pressure on the central government to check human rights violations in the valley. But they will not do so because they know without human rights violations either by the state machinery or by terrorists they cannot run their lucrative business of leadership on Kashmir. They themselves are the biggest violators of human rights by giving daily hartal calls. Because of these hartals children of daily wage earners go to bed without food.

             In an interview to a private TV channel recently, Mirwaiz Umar Farooq said the people in Delhi did not understand the ground reality in the valley. He is very much right. But throughout the world people are intelligent enough to put two and two together from a distance and their assessments are correct. Being in the Hurriyat Conference, the Mirwaiz is supposed to be Hurriyat pasand. But, when he goes to Islamabad and thence to Muzaffarabad in occupied Kashmir, does he ever bother to meet those persecuted Kashmiri leaders who have been fighting against the Pakistani occupation of Kashmir? No never he only meets the officials who are the Pakistani establishment’s agents to keep Kashmiris enslaved to Pakistan.

             In Kashmir it is very easy to agitate, give calls for hartals and incite young boys to throw rocks because here is democracy. This cannot happen in occupied Kashmir. There is the Army all over and there is the presence of Lashkar-i-Tayyaba , Jaish-i-Mohammad and other terrorists groups. In their presence there is no freedom for Kashmiris to express their views which are not liked by the establishments in Islamabad.

                      For a state government, it has always been a difficult task to govern Kashmir because the people have democratic rights and freedom to agitate. This fact can be better appreciated if a comparison is made with the part of Kashmir which Pakistan occupied in 1947 and misnamed it “Azad” Kashmir. If we see the 63 years old history of this “Azad” Kashmir we will find that successive Pakistani governments ruled it as a colony with or without constitutions tailored by them for this occupied territory. The present 1974 constitution was designed by then Prime Minister of Pakistan, Zulfikar Ali Bhutto for occupied Kashmir but not by the representatives of the kashmiri people. Under the constitution, the elected members of the assembly cannot legislate without the approval of a council that is headed by the Prime Minister of Pakistan and filled with his cabinet colleagues. The constitution empowers the government of Pakistan to seek any elected government in Muzaffarabad at will if it does not like it. It provides that no person can be eligible to fight elections if he of she is not committed to the ideology of Kashmir’s accession to Pakistan. The 1949 Karachi Agreement provides that even newspapers cannot write against this ideology. In other words, the people of occupied Kashmir cannot utter a word that Pakistan does not like. If he dares that, he disappears. Those who do not swear by this ideology cannot get jobs or even get their children admitted into schools. Schools are not allowed to teach the history of Kashmir or talk of Kashmiri heroes. School children are taught that heroes that Pakistanis worship are their heroes.

             Maharaja Hari Singh had promulgated state subjects rules so that non-Kashmiri outsiders did not settle down in Kashmir and grab its natural resources. While in India these rules are a part of its constitution, “Azad” Kashmir, and Gilgit-Baltistan have been purposely flooded by Pakistanis from Punjab and Khebar-Pakhtunkhawa. Kashmiris in these two regions are becoming extinct. If at all there is a plebiscite in future in these areas, Pakistanis, not Kashmiri, will decide their fate. Is that the solution the separatists in Kashmir are looking for? Some Kashmiri leaders who do not subscribe to this solution are too timid to swim against the current of frenzy generated by terrorists and Pak agents in Kashmir. PDP leader Mahbooba Mufti is an example.
